Slip and Fall: When You Have a Case
If you listen to critics of the tort system, it sounds as if a person is able to sue for millions of dollars every time he or she slips and falls in a public place, but this is not the case. The law allows people to sue in some circumstances, but in others it protects the property owner from frivolous or unreasonable lawsuits.
As much as we would like to, no property owner can immediately take care of every hazard or obstacle on a property. The law takes this into account, and states that there are only some circumstances in which a property owner is responsible for injuries suffered as a result of a slip and fall accident.
The Owner’s Responsibility
The owner has a responsibility to maintain the property in a reasonable fashion. Reasonable means that the property owner must address all known hazards in a timely fashion. This means that an owner must address all hazards that can cause a slip and fall if:
· They were caused by the owner or an employee of the owner, such as spills of fluids or slippery objects, tears in carpet or flooring, or the removal of flooring as part of maintenance or improvements.
· They are a normal and predictable outcome of observable conditions, such as wet spots inside the door during rain or snow, icy drives during the winter, or oily driveways following high-traffic intervals.
· They have been around long enough for a property owner taking reasonable care of the property should have noticed them.
· They result from a poor design or arrangement of the property.
If the conditions that caused your fault meet any or all of these conditions, then you probably have a slip and fall liability case. You can strengthen your case if you can show that the owner and employees do not practice regular, reasonable maintenance on the property. Collect evidence of other instances in which maintenance created hazards, even if these hazards did not result in falls.
The Victim’s Rights
If you slipped and fell as a result of a hazard on the property, you also have to prove that you were within your rights as a pedestrian at the time of the accident. To be within your rights, you must show that:
· You had a right to be in the place the fall occurred because it is either a public place or a private place to which you were invited for business or other reasons.
· The place you were walking was designated as a walkway or could reasonably be interpreted as a place for walking.
· You exercised reasonable caution while walking.
If you can prove that you were within your rights and the owner had a responsibility to rectify the hazard, you may receive compensation for your injuries as a result of the slip and fall.
The Lawyer’s Role
Obviously, the above conditions allow for a wide degree of interpretation. What exactly are the boundaries of “reasonable caution”? What might “reasonably be interpreted as a place for walking”? What constitutes a “normal and predictable outcome of observable conditions”? These are all things on which you must be able to convince a judge or jury to take your side. This requires both a knowledge of the law and a facility with language and persuasion. This is where a lawyer comes in.
